Mr. Neary is a well-recognized and experienced attorney in the areas of criminal defense, white collar investigations, and commercial litigation. He has gained a reputation as a skilled and formidable litigator through his representation of clients in both the Federal and Superior Courts of New Jersey, including the counties of Hudson, Union, Passaic, Essex, Middlesex, Bergen, and Morris. Recognized on the list of “Ones to Watch” in Best Lawyers of America for both criminal defense and commercial litigation, Mr. Neary is known for his superior ability to advocate, both in and out of court, to obtain favorable results on behalf of his clients.
Prior to joining MSR, Mr. Neary was an attorney at an office that dealt in high-volume criminal defense work where he was solely responsible for handling cases involving serious criminal offenses such as murder, robbery, sexual assault, vehicular homicide, kidnapping, burglary, financial crimes, weapons offenses, and narcotics offenses. Through this experience, he recognizes that comprehensive representation involves both an attentiveness to providing information and updates to clients related to the criminal justice process, and a honest assessment of potential outcomes based upon a thorough evaluation of each case. He also gained tremendous experience in handling both criminal and motor vehicle offenses in various municipal courts throughout New Jersey, particularly with a focus on cases involving individuals charged with driving while under the influence (“DWI”).
Mr. Neary’s experience and reputation also arises out of his former position as an Assistant Prosecutor with the Passaic County Prosecutor’s Office in Paterson, New Jersey. His career as an Assistant Prosecutor began with being assigned to the Domestic Violence Unit where he exclusively handled these matters involving crimes of domestic violence. Mr. Neary was later assigned to the Trial Unit where he gained extensive trial experience through acting as the lead prosecutor in numerous trials to verdict for charges including murder, attempted murder, aggravated manslaughter, robbery, aggravated assault, unlawful possession of a weapon, and narcotics distribution.
Following his position as an Assistant Prosecutor, Mr. Neary joined a large, well respected law firm as an associate in an aggressive high stakes commercial litigation and white collar criminal defense practice. In his role with this firm, Mr. Neary gained extensive experience in handling complex civil litigations including regulatory investigations, contract disputes, shareholder/ corporate dissolution matters and high value insurance cases. It is also at this firm where Mr. Neary met and worked along side Mr. Ramirez.
Mr. Neary previously served as a judicial law clerk to the Honorable Regina Caulfield, P.J.S.C. (Criminal), of the Superior Court of New Jersey – Union County located in Elizabeth, New Jersey. During law school, Mr. Neary was employed full-time as a Prosecutor’s Agent with the Hudson County Prosecutor’s Office in Jersey City, New Jersey, where he assisted both law enforcement and assistant prosecutors in preparing matters for trial.
Mr. Neary is a graduate of Lehigh University in Bethlehem, Pennsylvania, and was a Division-I athlete. He attended Rutgers University School of Law in Newark, New Jersey, where he served as a member of the Student Bar Association, vice president of the Criminal Law Society, and member of the National Mock Trial team. Mr. Neary currently serves as a trustee of the Hudson County Bar Association and an attorney member of the Office of Attorney Ethics & Discipline, District VI.
